1. Introduction

Umoment collects and processes personalized and non-personalized information to being able to provide it’s Products. 

 

2. Protection of personal data 

Personal data includes any information concerning the personal or factual circumstances of an identified or identifiable natural person or legal entity („Personal Data“). Personal Data such as name or e-mail address will be kept safe by Umoment.


Personal Data, that is published as agreed in a Product we provide, is inherently subject to any confidentiality. Data that does not need to be published by law or according to contract shall be treated as confidential. A transfer of confidential data to third parties only applies if:

  1. Such is necessary for the implementation of agreed services or 
  2. We are legally obliged to 

We collect, process and use data in machine-readable format in order to provide our Products or to improve our Products to match user requirements and to prevent the illegal or improper use of our Products and to take action against it.

 

3. Data Collection 

Our Products are located on computer servers. Everyone who uses our Products, agrees that data is collected and transmitted to our servers, and stored there.

We collect, process and use the following personal data:

  1. Name, e-mail address(es), photo(s), usage data, and where required financial information
  2. Registration and login information 

We collect and process the following additional non-personlalized information:

  1. Statistics regarding data traffic to and from our Products 
  2. Other data such as standard Internet protocol data exclusively for:
  1. statistical purposes,
  2. error detection and correction,
  3. improving the usability and value of our Products. 

 

4. Data usage, Data transmission 

We use and transmit personal information to: provide Products according to what we promise; enforce our Terms; comply with legal or regulatory obligations, to defend ourselves against claims arising from legal violations, and also to inform users about enhancements or new features.

 

5. Log files

We reserve the right to record and store usage log files for:

  1. statistical purposes,
  2. error detection and correction,
  3. improving the value and usability of our Products

 

6. Data Security

We have taken technical and organizational measures to ensure that our data processing system is protected from unauthorized access. However, it must be remembered that data transmission over the Internet can never be absolutely safe and cannot exclude the possibility that, for example, third parties without authorization gain knowledge of the transmitted data. 

 

7. Data usage by users 

Personalized data that is published in our Products (such as testimonials) may only be used for the designated purposes. Commercial use of such data or unsolicited advertising (spam) is expressly prohibited.

 

8. Cookies 

A cookie is a collection of data that a website sends the user’s browser, to be saved on the user’s computer as a file. Most of our services use cookies. You always have the opportunity to decide for yourself whether to allow cookies on your computer or not. To do this, use the settings of your web browser. However, be aware that the restriction or blocking of cookies, can eventually lead to functional restrictions or error messages. 

 

9. Analytics 

In order to enhance our Products and adapt to the changing habits and technical requirements of our users, we use analytics tools. We are interested, for example, which features are used most by our users, whether the information sought can be easily found, etc.

 

10. Google Analytics 

Our Products use Google Analytics, a web analytics service provided by Google Inc. („Google“). Google Analytics uses „cookies“, text files that are stored on your device, to help analyze how users use our Products. The information generated by the cookie about your usage (including your IP address) is transmitted to a Google server in the USA and stored there. Google will use this information to evaluate your use of our Products and compile reports. Google may also transfer this information to third parties unless required by law or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser. However, you may not be able to use all functions of these services fully in this case. By using our Products you consent to the processing of data about you by Google in the manner described above and for the aforementioned purpose.

11. Further analytics tools 

Umoment reserves the right to use other analytics tools in order to enhance its Products.

 

12. Social Plugins

Umoment uses plugins which allow the users to share content on social networks.

 

13. Final provisions 

  1. By using Umoment Products you agree to our Privacy Policy and also our Terms. We reserve the right to change this Privacy Policy at any time and independently. Users can object to these changes within one month by no longer using our Products and, where applicable, by deleting their account. 
  2. If any part of this Privacy Policy is invalid, the remaining parts always remain valid. 
  3. As long as this Privacy Policy doesn’t provide otherwise, the provisions of the Swiss law, in particular the Swiss Code of Obligations („Obligationenrecht“) apply. The place of jurisdiction is Bern (Switzerland).
